Your parents or spouse may still be able to get a visa to the United States even though you were born in a country that doesn’t qualify.

 

It could be that you were born in a country that doesn’t allow you to enter the green card lottery. If your spouse was born in a country that allows you to enter the lottery, you can claim your spouse’s country of birth as your country of eligibility.

 

I.e., if both you and your spouse are on the selected green card lottery application, you can claim that your spouse was born in the country where your derivative spouse was born. If both you and your spouse are also eligible for and get a diversity visa green card, you won’t be able to get a diversity visa green card.

 

Example: It doesn’t matter if you were born in Canada, which doesn’t allow you to enter the green card lottery. If you married someone who was born in Spain, which does allow you to enter the lottery, you can claim your spouse’s country of birth (Spain) as your country of eligibility.

 

In a similar way, a child who is dependent on a parent can be “charged” to that parent’s home country.

For people who were born in a country that isn’t part of this year’s diversity visa green card program, they can be “charged” to the country of birth of either parent as long as neither parent lived in the country where they were born at the time of birth.

 

It’s possible that, for example, your parents lived there for a short time because of their jobs. People are not considered residents of a country where they were not born or legally naturalized if they are only visiting, studying in the country for a short time, or stationed in the country for business or professional reasons for a company or government.

 

In the Diversity Lottery entry form you must fill out after you have registered successfully, under the country of Eligibility, you must say if you want to be charged with something else. Choosing the wrong country of eligibility or chargeability could disqualify your entry. If you can’t make a valid claim to this country, don’t choose it!

 

The American DV-2023 Lottery is only for people who have a lot of education or work experience.

To enter the USA DV-2023 Diversity Visa Lottery, you must meet one of the following two requirements: Option 1: You must be a citizen of the United States. Option 2: You must meet one of the following two requirements:

Option 1: You must have a U.S. high school education or the equivalent in another country to be eligible for the Diversity Visa Lottery. “High School education or its equivalent” means a successful completion of a 12 year course of elementary and secondary education in the United States or a successful completion in another country of a formal course of elementary and secondary education that is equivalent to a 12 year education in the United States.

 

You must have a high school diploma or GED. Passing a high school equivalency test is not enough. Less than 12 years, or more than 12 years, are fine ways to finish your education. When you enter the DV-2023 Lottery, you don’t need to show that you meet these requirements.

 

A consular officer will ask for proof after your name is chosen and you apply for a Green Card visa. They shouldn’t apply to this program if they don’t meet these basic rules. If you are chosen, you will need to show proof of your education, work experience, and home country.
